Gukga Bohunbu introduces tiered fines for reporting violations
Gukga Bohunbu has replaced a flat penalty for missed reports by employment-support providers with fines calibrated to repeated violations.
The revised enforcement decree introduces tiered fines of 1 million won ($724) to 3 million won ($2,173) for employment-support providers that fail to meet required reporting duties, replacing a system that imposed only the maximum penalty.
The revised schedule applies when providers have been fined for the same breach within the preceding two years, including penalties imposed before the revision. The revision rationale says the change is intended to improve the appropriateness of fine decisions for reporting-duty violations.
For repeat-offence calculations, the two-year period runs from the date a fine was imposed for an earlier violation to the date a later violation is detected. Where a provider has received more than one fine within that period, the next penalty level follows the highest previous level.
Authorities may lower fines by up to half for minor negligence, efforts to correct or resolve a breach or other mitigating circumstances, but not for those with unpaid fines. They may raise fines by up to half where a violation is considered serious and to have caused significant harm, or where a breach continues for at least six months.
