Korea moves welfare from 'apply and prove' to the state paying first

Four benefit laws are being rewritten for proactive payment, while the basic pension now takes a spouse's mobile consent and accepts documents later.

South Korea is dismantling the part of its welfare state that makes people ask. Under the old model, a pensioner needed a spouse physically present to consent to a financial check, a family needed a completed application form before child benefit moved, and a disabled applicant needed to prove a qualification the government partly held on file. That model is being replaced, on a timetable written into the subordinate legislation published for public comment on Oct. 30.

The Ministry of Health and Welfare is revising the enforcement decrees and rules of four laws — the Social Security Benefits Act, the National Basic Livelihood Security Act, the Child Allowance Act and the Disabled Persons Pension Act — with comments open until Dec. 9. The parent statutes, six amendment bills in all, passed the Cabinet and the National Assembly on Oct. 20 and take effect on Jan. 21, 2027.

The most consequential change is to the official's power to act without consent. Civil servants will be able to file a benefit application on someone's behalf, without that person's agreement, in three newly defined situations: a household flagged three or more times as at risk or at risk of a lonely death; a household including a suicide victim or attempt where the main earner has lost income; and a case where emergency support ended without the crisis being resolved. Previously such action was limited to people judged mentally incapable of deciding for themselves.

A second mechanism is presumed application. Once someone is confirmed as receiving one benefit — basic livelihood payments, the basic pension, the disability pension — the state can treat that as an application for another. For child allowance, parental benefit and the first-meeting voucher, the local government will send a bank-account consent form instead of waiting for a parent to apply; the deadline for a payment decision now runs from the day all documents are received, not the application date. The disability pension extends to all people with severe disabilities, and the data the social security system links in widens to include care workers who are family members and veterans' records.

The same week produced the online counterpart. From Oct. 30, the basic pension can be claimed through the government's welfare portal with a spouse's consent given by mobile phone — a texted link, answered whenever — and with documents like a lease contract submitted after the application is accepted. The ministry reported that only 3.4 percent of last year's 887,431 applicants applied online, and that of 2,467 abandoned online applications, 37.2 percent stopped at the consent step and 38 percent at document preparation. "I hope this improvement allows older people to apply easily and conveniently," Health Minister Chung Eun-kyung said.

The labour ministry's filings the same day are the other side of the same administration. On Oct. 29 it announced that retirement benefits must be held outside the employer for every workplace, phased in from 2028 for firms with 100 or more employees, 2029 for those with 10 to 99 and 2030 for those below 10, contingent on a bill passing this year; unpaid severance made up 41.1 percent of wage arrears in 2025, or 823 billion won ($616 million). It also ran a job fair in Magok where 45 domestic companies interviewed young people with overseas experience, and the head of the Korea Industrial Manpower Corporation, Lee Byung-hoon, said time abroad "is not a gap in a career but a different starting point."

What is not settled is the consent itself. The state is building a system that may pay before asking, and its own draft rules carve out the exceptions — officials acting without agreement, financial data checked only for the applicant in those cases — that will decide how far it goes. The comment window closes Dec. 9.
