Government legislation ministry says local officials may review land laws for animal shelters

The Ministry of Government Legislation said that local officials may examine whether proposed animal protection facilities violate farming or zoning laws before approving their operation reports. The ruling clarifies that mayors and governors are not limited to checking compliance with the Animal Protection Act alone but can also assess adherence to the Farmland Act and the Act on Planning and Utilization of Land.

Issued in response to a query from the Agriculture Ministry, the interpretation determines that substantive review extends to other relevant statutes. Officials may refuse approval if installing or operating a facility is prohibited under restrictions on agricultural land use or building limits based on zoning districts. The ministry noted that approving a report only to later discover the facility cannot legally operate would force the relocation of protected animals and create unnecessary administrative burdens.

The interpretation concluded that since the laws serve different purposes and none explicitly excludes the application of the others, local authorities must ensure all legal conditions are met before granting approval. While the Animal Protection Act requires officials to approve reports that meet its specific criteria, the ministry argued this provision aims to ensure transparent and swift processing rather than barring reviews under other statutes. Case No. 26-0641 affirms that when a facility's location is absolutely prohibited by other laws, considering those violations at the reporting stage serves the public interest.
