Government legislation ministry rules protruding canopies must clear property lines

The ministry clarified that fixed canopies attached to buildings count as part of the structure for setback calculations under the Building Act.

The Ministry of Government Legislation said that the outer edge of a fixed protruding canopy must meet minimum distance requirements from building lines and adjacent property boundaries. The ruling clarifies that such structures count as integral parts of a building rather than separate attachments when calculating mandatory setbacks under the Building Act.

The decision came in response to a public inquiry asking whether the distance regulations apply to the canopy's tip or the building's exterior wall where it is mounted. The ministry concluded that because the law defines a building to include attached facilities, the farthest point of a fixed canopy constitutes the relevant boundary for measuring compliance with spacing rules.

The interpretation prioritizes securing actual space for light, ventilation, and emergency evacuation over technical accounting methods. Officials rejected arguments that technical exemptions used for calculating floor areas should apply to safety distances. While building codes allow certain overhangs to be ignored when computing total square footage if they extend more than one meter, the ministry stated those are purely technical measures distinct from the public safety objectives governing land usage and separation distances. Ignoring the protrusion would undermine the statutory goal of ensuring minimum open space for fire suppression and refuge.

The Ministry of Government Legislation issued the formal interpretation on July 21, case number 26-0446, to guide consistent enforcement across local authorities. However, the ministry noted that while its interpretations serve as guidelines for unified executive execution, they do not carry the same legal binding force as a final court judgment and may be applied differently by competent agencies depending on specific factual relationships.
