Government legislation ministry rules weekends count in elevator inspection deadline

The Ministry of Government Legislation said on July 8 that building managers must include Saturdays and public holidays when calculating the 10-day deadline to enter elevator self-inspection results into the national safety network.

Under current regulations, management entities are required to conduct safety checks at least once a month and submit findings within 10 days of the inspection date. The ministry determined that because the law does not explicitly exclude weekends or holidays, the standard civil code applies, which counts all calendar days toward such deadlines.

The ministry noted that other laws, such as those governing fire safety facilities, specifically exclude weekends when lawmakers intend to do so, but no such exception exists for elevator inspections.

It rejected arguments that a law regarding general administrative petition processing should apply by analogy, stating that routine safety reporting differs significantly from processing specific administrative requests.

The ruling, issued under case number 26-0321, addresses a query on whether the 10-day input period stipulated in Article 29, Paragraph 3 of the Elevator Safety Management Act Enforcement Decree should include non-business days. The provision requiring results to be entered within 10 days of the self-inspection was newly established on January 21, 2025.
