Government legislation ministry rules most facilities can enter knowledge industry centers

The ministry clarified that any facility not explicitly excluded by presidential decree qualifies for entry under the Industrial Cluster Development Act.

The government legislation ministry said Tuesday that facilities are permitted to occupy knowledge industry centers, provided they are not specifically banned by law.

Under the interpretation, any facility that does not fall under the exclusion list in Article 36-4, Paragraph 2 of the enforcing decree of the Industrial Cluster Development and Factory Establishment Act is eligible. No separate assessment is required to determine whether a specific facility supports tenant production activities.

The ruling follows a revision of the decree intended to expand the scope of eligible tenants and activate knowledge industry centers by shifting from a list of permitted facilities to a list of prohibited ones.

Barred facilities include those dedicated to agriculture, forestry, fisheries, mining, gambling, residential structures such as single-family homes and apartments, isolated hospitals, accommodation facilities, animal-related establishments, and defense installations. Local authorities retain the power to deny entry to any facility deemed likely to disrupt existing tenants' production activities.

The ministry issued the interpretation on May 19 in response to an inquiry from the Ministry of Trade, Industry and Energy regarding the scope of facilities eligible under Article 28-5 of the act.
