Supreme Court rejects vague appeal grounds in contract dispute
The court ruled that stating an intent to submit specific reasons later does not satisfy legal requirements for a valid appeal.

The Supreme Court dismissed an appeal in a contract dispute, ruling that a notice containing only a generic claim of factual error without specific grounds is invalid under South Korean civil procedure laws.
In its decision regarding case 2025Ma9010, the high court determined that an appellant who merely claimed the lower court's judgment contained errors affecting the outcome and promised to submit concrete reasons later failed to meet statutory requirements. The ruling was issued on February 26.
The court emphasized that an appellant must specify the contested portions of the first-instance judgment to allow the opposing party to prepare a rebuttal and ensure the trial focuses on relevant issues. Civil Procedure Rules require appellants to cite specific grounds from designated categories and identify exactly which parts of the lower ruling they are challenging, rather than submitting a placeholder statement.
While appellants have 40 days from receiving notification of the appeal record to submit a detailed statement of grounds, the initial notice itself must identify specific points of dispute rather than deferring them indefinitely.
