Supreme Court sends real estate commission case back to lower court
The court ruled that judges must provide clear rational grounds when reducing agreed-upon brokerage fees based on fairness principles.
The Supreme Court sent a dispute over real estate brokerage commissions back to the Gwangju District Court, ruling that the lower tribunal failed to specify concrete facts justifying a fee reduction. The high court held that while courts may limit excessive fees under principles of good faith and equity, they must clearly articulate the rational basis for such exceptions.
The case originated from a conflict where a defendant requested land acquisition services from the plaintiff for a regional housing association apartment construction, leading to a dispute over the brokerage fee for the relevant real estate sales contract. The lower court previously reduced the agreed brokerage fees by 50 percent ex officio, viewing them as excessive. The Supreme Court found that the original judgment reduced fees based solely on abstract circumstances rather than analyzing concrete facts regarding the restriction of brokerage fees.
Agents are generally entitled to their full agreed-upon fees unless special circumstances make the amount unfairly excessive. In its ruling, the court specified that judges must consider factors such as the background of the mandate, the progress and difficulty of the brokerage work, the degree of effort invested, the concrete benefits gained by the client, and various other circumstances revealed in the arguments before limiting a claim. Because the lower court did not establish these reasonable grounds explicitly, the Supreme Court broke the previous decision regarding the plaintiff's loss and remanded the case for further review.
The judgment, issued on February 12 in case number 2025Da212052, reaffirmed that restricting contractually agreed fees is an exception to the principle of freedom of contract. Consequently, any court ordering a reduction bears the burden of proving that the agreed amount violates good faith principles through specific evidence presented during the trial.
