Land ministry revises 25 decrees to fix legal inconsistencies

The land ministry revised 25 presidential decrees under its jurisdiction to improve legal consistency and correct administrative errors. The omnibus revision addresses discrepancies between lower-level regulations and their parent statutes while fixing incorrect citations found across multiple laws.

A primary focus of the update was aligning the procedures for demanding and collecting surcharges with the requirements set forth in higher-level legislation. The new text brings these mechanisms into compliance with the overarching legal framework.

The ministry also corrected specific citation errors that had arisen because earlier amendments to other laws were not properly reflected in related decrees. In the Road Act Enforcement Decree, a reference to Article 29, Paragraph 3 of the Motor Vehicle Management Act was updated to cite Paragraph 4 instead.

Another change altered the requirement for obtaining consent from the head of a regional maritime and fisheries office to merely consulting with them. This shift in the Road Act Enforcement Decree ensures that inter-agency protocols match the collaborative spirit mandated by superior laws.

These adjustments were executed through a single legislative instrument titled the Presidential Decree on Partial Amendments to 25 Laws Under the Jurisdiction of the Ministry of Land, Infrastructure and Transport for the Purpose of Enhancing Legal System Consistency. By bundling these technical fixes into one decree, the government aimed to streamline the regulatory landscape.

The legislation stipulates that it enters into force on the day of promulgation. The Legislative Affairs Office provided the rationale for the batch revision, emphasizing that maintaining harmony within the legal system requires updates whenever parent statutes change or when clerical errors are discovered in subordinate regulations.
