Government legislation ministry clarifies local council quorum rules

Members with direct interests can count toward opening local council meetings but not voting quorums under the ministry's interpretation.

The government legislation ministry said that local council members with direct interests in an agenda item may count toward the number required to open a meeting, but not toward the voting quorum.

The Uiwang City Council in Gyeonggi Province sought clarification on whether members barred from participating in a particular agenda could be included as present when calculating both quorums. The ministry issued its response on May 6 in case No. 26-0269.

At least one-third of a council's members must be present to open a meeting. The ministry said Article 82 of the Local Autonomy Act contains no separate provision requiring recused members to be excluded from that count. Members subject to recusal retain their status as council members and are not barred from attending a meeting.

For voting, a council normally needs a majority of its members present and approval from a majority of those attending. Recused members cannot be included in the attendance count. The ministry said a voting quorum assumes that members present can express their views on the agenda item. Including a recused member could affect the number of votes needed to pass a measure even though that member cannot participate in the decision.

The restriction covers agenda items involving the direct interests of a council chair or member, their spouse, lineal ascendants or descendants, or siblings. With the council's consent, a recused member may attend a meeting and speak.

The ministry's statutory interpretations provide a government standard for administrative agencies applying laws. They do not legally bind relevant administrative agencies in the way court rulings do, but serve as a de facto benchmark for consistent government administration.
